Terms § 1. SCOPE These General Terms and Conditions (GTC) apply to all contracts between nuvu GmbH and consumers that are concluded via the www.nuvu.ch online shop. § 2. CONTRACT PARTNERS, CUSTOMER SERVICE The purchase contract is concluded with nuvu GmbH. For questions, complaints and objections please send an email to: info@nuvu.ch § 3. CONCLUSION OF CONTRACT Your order represents an offer to us to conclude a sales contract. If you place an order with nuvu, we will send you an email confirming receipt of your order and listing its details (order confirmation). This order confirmation does not represent an acceptance of your offer, but only informs you that we have received your order. Please note that we sell all our products only in quantities customary in households. § 4. PAYMENT The purchase price is to be paid in advance via credit card, Paypal or prepayment by bank transfer, plus the shipping costs shown on the offer page (foreign countries), since each order is manufactured individually for you. The possibility of the purchase against invoice can be granted for large customers in individual cases after examination by us. § 5. RIGHTS OF USE With the purchase of a photographic print you acquire only the real property of the print. No other rights of use are granted. Any reproduction (duplication), distribution, leasing, making available to the public or any other analogue or digital use is not permitted. Resale is permitted. The public exhibition of acquired works of art requires the consent of the artist concerned in individual cases. § 6. DELIVERY/SHIPPING Unless otherwise agreed, delivery shall be made to the address of the customer or to the delivery address specified by the customer. Information on the delivery period is non-binding unless the delivery date has been bindingly agreed as an exception. The buyer must immediately inspect the goods for damage and notify the forwarding agent before accepting them. Should obvious damages be present and only be noticed after acceptance, the buyer must notify us of this within a period of 5 days after acceptance. If the buyer fails to do so, the assertion of notices of defects for such obvious damages is excluded. We deliver by dispatch. A self-collection of the goods is possible after arrangement. § 7. SHIPPING COSTS We deliver free of charge within Switzerland. If the delivery address is outside Switzerland and the EU, import duties and value added tax of the respective countries will be charged to your account. § 8. RIGHT OF WITHDRAWAL The photographs we take are custom-made, which we have produced directly on request. Unfortunately, we cannot offer you a right of withdrawal for these special productions. § 9. RETENTION OF TITLE The delivered goods remain the property of nuvu GmbH until complete and final payment has been made. § 10. APPLICABLE LAW Swiss law is applicable to the contractual relationship. Place of jurisdiction and performance is Zurich.
